I just want to add this points : Pu Sandman says “Who will watch the watchers?” This act will be a very transparent system where in the people will be watching this so called watchers…!
I understand the possibilty of misusing this act but i also understand if this kind of strong act be put in place, there will be a drastic reduction in Corruption in national level…!! There are always loopholes in everythg, see you sofware code for instance…!! You will find a lot of weakness in a single snippets of code.. but the point is it works and i helps u work more efficiently.. eventho ther are attackers who try to harm u maliciosly..
When I visualise about a long term, it can definitly be misused.. but this act can be ammended time to time.. Its like u see a bug, find out the cause and fix it.. (maintenance lies in our hands). Its you, me and the citizens of this country who is responsible to see this act works just fine rather than worrying about how it will be misused in long run..!! The Jan Lokpal bill will be just a tool, a way for us to challenge these corrupt politicians…! The current situation is, the general mass of population doesn’t even understand how govt is makin money…!! Tax for instance… !
Like RTI, i smhow can see that this act will be really useful…!! RTI Act has been instrumental in dealing with corruption at a vry ground level..!! It helps Pu Sandman..!! Coz there has been an instance wen a file of sm rural area person was put on HOLD for approx 6-7months for want of bribe, but when this guy files an RTI it was cleared in 10 days..!! This is just an example…!! So This draft (Lokpal) I suggest should be read by everyone and supporting Anna is your will…!!

Like I said, it will definitely help, but at the same time, there can be serious repercussion from its misuse too.
Example pakhat chu – POTA act kha. lolz. Tamilnadu a ka awmlai a an pass a nih avangin ka hre chiang hle. POTA kha coimbatore bomb blast hnu a an pass a ni ta in ka hria. Where police have more authority and force to catch and persecute “suspected terrorists” quickly (similar to the AFSPA in North East) without the need to show any proof. One can say this is also against human rights. In the short run, yes, it really helped the police crack down terrorist cells quickly as they didnt need any warrant or legal roadblocks etc. In the long run? Jayalalitha used it to her advantage and threw Karunanidhi and other opposition members in jail under this act! And when DMK came to power the next election, Karunanidhi threw Jayalalith in jail using this same act! And there’s nothing people can do to defend themselves, hence making a mockery of us and the constitution. Thats the kind of misuse I’m afraid will happen too.

1. Existing System:
No politician or senior officer ever goes to jail despite huge evidence because Anti Corruption Branch (ACB) and CBI directly come under the government. Before starting investigation or initiating prosecution in any case, they have to take permission from the same bosses, against whom the case has to be investigated.
System proposed by civil society:
Lokpal at centre and Lokayukta at state level will be independent bodies. ACB and CBI will be merged into these bodies. They will have power to initiate investigations and prosecution against any officer or politician without needing anyoneâ³ permission. Investigation should be completed within 1 year and trial to get over in next 1 year. Within two years, the corrupt should go to jail.
2. Existing system:
No corrupt officer is dismissed from the job because Central Vigilance Commission, which is supposed to dismiss corrupt officers, is only an advisory body. Whenever it advises government to dismiss any senior corrupt officer, its advice is never implemented
Proposed:
Lokpal and Lokayukta will have complete powers to order dismissal of a corrupt officer. CVC and all departmental vigilance will be merged into Lokpal and state vigilance will be merged into Lokayukta.
3. Existing:
No action is taken against corrupt judges because permission is required from the Chief Justice of India to even register an FIR against corrupt judges.
Proposed:
Lokpal & Lokayukta shall have powers to investigate and prosecute any judge without needing anyone’s permission.
4. Existing:
Nowhere to go – People expose corruption but no action is taken on their complaints.
Proposed:
Lokpal & Lokayukta will have to enquire into and hear every complaint.
5. Existing:
There is so much corruption within CBI and vigilance departments. Their functioning is so secret that it encourages corruption within these agencies.
Proposed:
All investigations in Lokpal & Lokayukta shall be transparent. After completion of investigation, all case records shall be open to public. Complaint against any staff of Lokpal & Lokayukta shall be enquired and punishment announced within two months.
6. Existing:
Weak and corrupt people are appointed as heads of anti-corruption agencies.
Proposed:
Politicians will have absolutely no say in selections of Chairperson and members of Lokpal & Lokayukta. Selections will take place through a transparent and public participatory process.
7. Existing:
Citizens face harassment in government offices. Sometimes they are forced to pay bribes. One can only complaint to senior officers. No action is taken on complaints because senior officers also get their cut.
Proposed:
Lokpal & Lokayukta will get public grievances resolved in time bound manner, impose a penalty of Rs 250 per day of delay to be deducted from the salary of guilty officer and award that amount as compensation to the aggrieved citizen.
8. Existing:
Nothing in law to recover ill gotten wealth. A corrupt person can come out of jail and enjoy that money
Proposed:
Loss caused to the government due to corruption will be recovered from all accused.
9. Existing:
Small punishment for corruption- Punishment for corruption is minimum 6 months and maximum 7 years.
Proposed:
Enhanced punishment – The punishment would be minimum 5 years and maximum of life imprisonment.
