Issues and Problems
The question of Gorkha identity cropped up in the early part of 1980s, when the influx of people from Nepal increased. They lived in the outskirts of Aizawl as cowherds and supplied milk to the city. Though they did not constitute any threat to the people of Mizoram economically, the latter perceived demographic threat with the multiplication of the Gorkha population in the state. It alarmed the permanent Gorkha settelers too.

The Mizoram Gorkha Youth Association along with the Gorkha leaders immediately took up the matter. They appealed to the government to recognize the permanent Gorkha inhabitants as on of the tribes and extended facilities as par with the natives. They also demanded to the government to undertake census of this community to identify the permanent Gorkhas. Accordingly, the government of Mizoram has ordered state-wide Gorkha census.

Meanwhile the then Congress Government had thoroughly examined the demands of the Gorkhas and accorded the following facilities: granting of post-matric scholarship. Extension of facilities in the matter of education, land settlement certificates including transfer of ownership, employment and trade and commerce at per with their Mizo counterpart and issue of permanent residential certificate.

For the purpose of extending these facilities, the census of Gorkhas who were permanently residing in Mizoram prior to 26-01-1950 as furnished by the Deputy Commissioner was taken as the basis of the genuineness of their claim. But it was vehemently opposed by the Mizo Students’ Joint Action Committee by burning the official gazette and demanded immediate cancellation of it. The Gorkha leaders, on their part demanded to apprise the government with the plight of their community and urged for reconsideration of their demands.

When the general Assembly Election of 1998 was announced, the Mizo National Front, in its election manifesto made the following promises to the Gorkhas provided they formed the government: As per Indian Constitution and Ministry of law, Notification No.
( a ) SRO of 10 August, 1950, the permanent Gorkha settlers shall be given the status of other Backward Classes and extend all the facilities enjoyed by this section at par with other Indian States.

( b ) The Mandal Commission recommendation once accepted by the government shall be applied to the Gorkha community.

( c ) The District Council Rules and Regulations adopted by the government of Mizoram in regard to land, issue of passes, periodic patta and land Settlement Certificate would continue to be practiced.

( d ) As per peace accord of 1986, the Gorkha community shall be included in Mizoram State Minority List and their rights and privileges shall be protected21.

In may 2001, on the basis of the recommendation made at the meeting of the Council of ministers held on 31-03 1998, the government of Mizoram had decided to accept the final figure of 4453 as the number of Gorkhas who have been in Mizoram prior to 26-01-1950 and their descendents. The government has further directed the concerned departments for issue of Land Settlement Certificate / Passes in respect of the lands traditionally held by them. However, other facilities are yet to be extended to them.

Another problem is the rules and regulations (of 2002) for selection of candidates for higher and technical (medical, engineering etc.) courses which do not accommodate the children of all selections of permanent Gorkha residents of Mizoramin the category II of the Mizoram Gazette.

Because the clause states, ‘but serving under the Government of Mizoram. Corporation or Autonomous Body under the state Government or other recognized organizations under the state Government who are regular employees of such organizations. This clause debars the children of the permanent Gorkha residents of Mizoram who are not employees of the government of Mizoram from being selected as candidates for higher and technical courses.

The most crucial problem of the Gorkha community in Mizoram at present is the question of the status of the Other Backward Classes (OBC). When the Mizo Dstrict was a part of Assam, the Gorkhas living in the state of Assam were categorized as “Other Backward Classes” under Nepali in 1961. With the attainment of the Union Territory and Statehood, the Government of Mizoram issued OBC Certificate to the permanent Gorkha residents of Mizoram, under the Mizoram Category of the backward classes under the Constitution (Scheduled Cast) Order1951.

However, the government of Mizoram, without giving any reasons, has stopped the issuance of the Other Backward Classes certificates to the bonafied children of Gorkha permanent settlers as a result of which the young Gorkhas are facing problems in various fields. In fact, the Gorkha community of Mizoram has been identified as Other Backward classes by the second Order Backward Commission (Mandal Commission) and the Government of India has approved it in 1990.

To substantiate their claim as one of the Other Backward Classes, the Gorkha leaders approached various State Governments, viz., Assam, Nagaland, Meghalaya, Haryana and Punjab where the Gorkhas are awarded the status of the OBC category and requested to forward their notification to the Mizoram Government for necessary action.

On 23rd January, 2006, the MGYA met the members of the National Commission of the Linguistic and Religious Minority here in Aizawl and apprised them of the problems faced by the Gorkhas of Mizoram. The omission has asked the representatives of the Community to the settle the matter of OBC status with the State Government.

The MGYA and other organizations are pursuing with the Government of Mizoram for early finalization of their demands. The Chief Minister of Mizoram, in his speech on the occasion of the 29th Annual Assembly of MGYA, held on 10th February, 2006, has assured the permanent Gorkha residents that his government is looking after the issue and is under active process. He promised to finalise the matter as soon as possible.

Thus, once the OBC status is granted, the problems of this community would be greatly reduced even though the Gorkhas of Mizoram have not faced any serious problems and threats in the fields of education, economy, politics, legal or cultural matters from the native people. The community maintains cordial relations with the Mizo by speaking their language, mixing up with while keeping their own culture and identity alive.
